Which is a large part of why I wanted my fic to take place so far in the future. I wanted the events in the game to be somewhat... shrouded in myth and outside the public's mind. The game was the Legend of Legaia, so the events need to have some sort of mythos associated with it.
Do not question yourself with the why or the how. I simply am, and that is all you need to know.

Makes sense to think of the first game as a legend. After all, stories always come out better than in real life (Legend of legaia > Legaia 2). So in a sense, using the first game as a Legend makes sense since the game worlds are still similar to one another... Such as some of the monsters you encounter in the wild (e.g. lyps/lippian)

Nope, copyright is pretty much eternal. (Life of the author / creator + 70 years, or 95 years if it's a corporate entity that owns the copyright) You'll never be able to directly make copies of the game for personal use.
Trademarks, on the other hand, do lapse if they are not continuously used, and it's stated in at least one place on this very site that the trademarks to Legaia are dead and freely usable by the public.
